- Acceptance of Terms
Welcome to CustomMetalAZ.com, a website operated by Rob Rise LLC (doing business as Custom Metal AZ). By accessing or using our website (including submitting quote requests or service inquiries through it), you acknowledge that you have read and agree to these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use the site. Your continued use of the site signifies your acceptance of and agreement to these Terms.
- Use of the Website
We provide this website for your personal, lawful use in learning about our custom metal fabrication and installation services and contacting us for quotes or information. By using the site, you agree to:
- Provide Accurate Information: If you submit a contact form or request, you will provide truthful, accurate information.
- Use the Site Legally: You will use the site only for lawful purposes. You will not use it in any way that violates any applicable law or regulation.
- No Harmful Behavior: You will not introduce any malicious code (viruses, worms, etc.), attempt to hack or disrupt the site, or use the site to spam, harass, or harm others.
- Respect Intellectual Property: You will not use our content in a way that infringes on our rights (see Section 4 below).
If you violate these Terms or misuse the site, we may terminate or restrict your access at our discretion.
- Separate Project Agreements
Important: If you decide to hire Custom Metal AZ/Rob Rise LLC for a custom fabrication or installation project, you will enter into a separate written contract with us (for example, a Bespoke Structure Agreement or a similar project-specific agreement). That formal agreement will govern all the specific terms of the project, such as:
- Payment Schedules and Terms (how and when payments are made, and any related lien rights or financial terms)
- Lien Rights and Obligations (your rights and our rights under lien laws, if applicable)
- Warranty Terms (any guarantees or warranties on the work, and their duration and conditions)
- Inspection and Approval Procedures (how and when project milestones or final work are reviewed, inspected, and approved)
Those project agreements are separate from these website Terms. The detailed provisions in your project contract (including any referenced sections, e.g. Section 7, Section 9 of the Bespoke Structure Agreement) will solely govern the topics they cover. In other words, if you enter a project contract with us, the terms in that contract (not the general terms on this website) will control things like payments, warranties, and project-specific rights and responsibilities. These website Terms are meant to cover your use of the site itself and general legal protections, not the specifics of any custom work agreement. If there is ever a conflict between these website Terms and a signed project agreement, the project agreement will take precedence for the project in question.
- Intellectual Property
All content on the Custom Metal AZ website – including text, images, logos, graphics, design, and layout – is owned by Rob Rise LLC or used with permission. This content is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our website content without our prior written consent. You are welcome to view, download, or print materials from the site for your personal, non-commercial use (for example, printing a project description for reference), but any other use (especially for commercial purposes) is prohibited.
The name Custom Metal AZ, our logo, and any product or service names or slogans on the site are trademarks of Rob Rise LLC. You are not granted any license or right to use them by simply using the website. Unauthorized use of our intellectual property is a violation of these Terms and may also violate the law.
- Third-Party Links and Services

- Right to Subcontract or Use Third Parties
Rob Rise LLC (Custom Metal AZ) reserves the right to subcontract or partner with third-party service providers to fulfill our services or projects. This means that for certain aspects of a project (for example, specialized tasks like electrical work, powder coating, or installation requiring specific licenses), we may hire qualified subcontractors or licensed professionals. We will ensure that any subcontractor or third-party we engage is properly licensed (if required by law) and is capable of performing the work to our standards. Using subcontractors or partners does not diminish our obligations to you under any project agreement – we remain responsible for delivering the project as promised. This clause simply means we have the flexibility to involve other qualified people or companies to help complete your project, in compliance with all applicable state and local laws.
- Disclaimers of Warranties (Website Use)
Use at Your Own Risk: Your use of this website is at your sole risk. We provide the site and its contents “as is” and “as available,” without any warranties of any kind. Rob Rise LLC disclaims all express or implied warranties regarding the website, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or availability. We do not guarantee that the site will be uninterrupted, error-free, or secure, nor do we guarantee that any content is up-to-date or reliable.

This includes, but is not limited to, any loss of profits, loss of data, business interruption, or other intangible losses, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from or related to your use of the site is limited to $10 USD or the amount you have paid to us via the site (if any), whichever is lesser. Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties, so some of the above disclaimers or limits may not apply to you – in such cases, our liability and warranties will be limited to the maximum extent permitted by law.
By using this site, you understand and agree that Custom Metal AZ will not be liable for any damages except as explicitly provided above. If you are dissatisfied with any aspect of the site or these Terms, your sole and exclusive remedy is to stop using the site.
- Dispute Resolution
We are committed to customer satisfaction and encourage you to contact us to resolve any issues. In the event of a dispute or claim arising out of your use of the website or these Terms, you agree to first try to resolve the issue informally by contacting us (email us at admin@custommetalaz.com or use the contact information on the site) and providing a brief written description of your dispute and your contact information. We will do our best to resolve the matter through good-faith discussions within a reasonable time.
Arbitration: If we are unable to resolve the dispute informally, you and we agree to resolve any remaining dispute through binding arbitration, rather than in court. This applies to any claim arising from or relating to your use of the site or these Terms (including the validity, enforceability, or scope of this arbitration provision), to the extent permitted by law. The arbitration will be conducted by a neutral arbitrator agreed upon by both parties. If we cannot mutually agree on an arbitrator, either party may request that the American Arbitration Association (AAA) or a similar reputable arbitration organization appoint one. The arbitration will take place in Arizona (unless you and we agree on another location), and it will be conducted in English. Each party will bear its own arbitration costs and attorney’s fees, except as may be provided by law or the rules of the arbitration forum.
No Class Actions: You agree that you will pursue any dispute only on an individual basis, and will not join your claim with the claims of any other person or entity in a class or consolidated action. The arbitrator can only decide your and/or our individual claims; the arbitrator may not preside over any form of a class or collective case.
Waiver of Jury Trial: By agreeing to arbitration, both you and we are giving up the right to a trial by jury and to have any dispute heard in court (except for matters that may be taken to small claims court or that involve requests for temporary injunctive relief as noted below).
Exceptions: Negotiation and arbitration will not be required for (a) small claims that qualify to be brought in a small claims court (you or we can choose to pursue those in such court), or (b) a party’s request for an injunction or other equitable relief to stop unauthorized use of intellectual property, confidentiality breaches, or other serious issues (in such cases, either party may go to court to seek that relief without posting a bond, if applicable). Aside from these exceptions, this arbitration agreement covers all disputes between you and us relating to your use of the site or these Terms.
We hope to never have a dispute with our users, but if it happens, this section ensures a fair and efficient way to resolve it.
- Governing Law
These Terms and any dispute arising from your use of the website are governed by the laws of the State of Arizona, USA, without regard to its conflict of laws principles. This means that the interpretation and enforcement of these Terms will be based on Arizona law. If for any reason a dispute is deemed not subject to the arbitration provision above (or if an exception applies), then you agree to the exclusive jurisdiction of the state or federal courts located in Maricopa County, Arizona for resolving that dispute. You also consent to venue in those courts and waive any objections to such jurisdiction or venue (unless you are legally entitled to a different venue as a consumer).
- Changes to These Terms
Rob Rise LLC may update or modify these Terms of Service from time to time. If we make material changes, we will post the updated Terms on this page with a new “Last Updated” date. It is your responsibility to review these Terms periodically. By continuing to use the site after any changes are posted, you accept and agree to the revised Terms. If you do not agree with a change, you should stop using the site. We may (but are not obligated to) also notify users of significant changes via email or a notice on the website. However, regardless of notice, the currently posted Terms will apply to your use of the site.
